What should I do with my dependent's visa when I apply for ILR?

Only for the UK Skilled Worker visas, formerly known as Tier 2 visa route

What should I do with my dependent's visa when I apply for ILR?

Post by myself19999 » Sun May 01, 2022 7:41 am

I am currently on a tier 2 visa (expiring in June 2023) and It is going to be my 5 year anniversary on 20th July this year (my visa started in July 2017)
My wife is currently on a tier2 dependent visa(expiring in June 2023).
She starts living with me in the UK with that visa 2 years later than my visa start date:
Sep 2019 - July 2020 (tier 2 dependent)
July 2020 - Present (tier 2 dependent) (another application because my visa was renewed in July 2020)

I am going to apply for my ILR in July but I am not sure what to do with my wife's visa so that she will not reset her 5 years of her ILR application. I have some questions:
1) As her dependent visa is expiring in June 2023, Do I still need to renew her visa when I apply for my ILR visa in June/July 2022? Can I renew her visa later but before June 2023?
2) If I need to renew her visa, what is the most appropriate timing to do so? Should I submit the application to renew her current visa at the same time as when I apply for my ILR?
3) Which type of visa for my wife should I apply for?
4) Any tips or things I should have in mind? As I have heard some cases where their dependent who join late got their 5 year reset due to some mistakes. (maybe a wrong visa type)

Many thanks!

Your ILR will have no effect on her visa. She will need to extend just before her visa expiry in 2023, under the Skilled worker dependent visa
