what do I do.

Hi there
I came to the Uk illegaly 2001,I stayed like this till 2008,within these periods, I had 2 kids,now 7.5yrs and 4 yrs old,I had a new relationship and got married abroad,after 17 months,I was giving a spouce Visa,now back in the Uk and now have a child who is nearly 2yr old with my wife,just after 4 months the marriage broke down,my questions are:
Can I still apply for ILR after my 2yrs expires as a spouce of a british citizen?
Can I apply under the circumstance that I have kids of school ages here?
She is threathening to notify the Home office that we are seperated, would they instigate removal?
What are my best options?
I have heard of rule 248a,how does this apply to me?
Im wating for your kind reply.

Yes i do, as a matter of fact,Im still staying at our flat in the back room with my wife and Son,I have acces to my other kids as i go and visit them at weekends.Im planing to move out to my own place soon though.

As you have access to your children, you might well succeed in getting a visa under para 248A of the Immigration Rules. It is probably best that you seek professional advice in order to make that application.

Ok, thanks, will go fru that rout,but do I have to wait till my 2 years spouce visa expires?

Ok will do just that, one more thing, what about this thing called Contact order,if I ask her and she refused and I go to the courts to get one,would that be a good start,sorry to be a pain.

As I say, you need to get professional advice!

But the way, which children do you have contact with? The older two, or the younger one ..... or all three?

ok,well I have contact with all three,but Im more likely to see my son more cos I will be living in London ,Im only just planing to move out as my wife wants this.
