When can he change his status?

I am a British Citizen.I officially got married to my husband in June 2009.He was granted asylum and has 5 year settlement visa which he got in 2008 and due to end in 2013.He has been in the country since 2002.what I need to know is is he eligible to transfer on to my status so that he can obtain his ILR early or do we have to wait until 2013. I did not want to just apply just in casehe is not due and we lose our money.Thanks for your responses

thanks Vinny.My husband has a residence permit valid for 5 years which he was given after being granted asylum as a refugee.

He would not get his ilr any quicker if he applied for leave as your spouse as he would still need to complete to years leave as your spouse before qualifying for ilr. In addition the requirements for ilr as a spouse are harder than ilr for a refugee.
