When does a person becomes an overyer?

Just a quck question but very tricky. Normally, when is person is given 28 days to leave the country when when his application for leave to remain is refused. When effectively does he becomes an overstayer? Is from the date when his application was refused or after the 28 days he was asked to leave have passed?

If a person was served with an immigration decision (e.g. further leave to remain is refused) then in-country appeal rights could follow. If the person exhausts his/ her appeal and still remains in the UK, s/he would then become an overstayer.
