When Should we apply for application?

Post by tapash » Thu Jun 18, 2015 10:01 am

First question is there a difference between ILR and PR?

2nd Q is, I am very confused about the changes of rules of UKBA.
So my situation is like....

I Got married to a EEA National (Lithuanian) in June 2010
She registered under WRS in August 2010
I received my FMRS in 2011
I received my EEA2 Visa till 2016
In the meantime we have been both working without any gap.

So, when should I apply for my EEA4 visa? or rather what type of visa I should apply for now? and when should my wife (EEA partner) should apply for British citizenship?

PS: We had a baby in 2014, and we have been receiving Working tax credit, child tax credit & child benefit. They were joint claim. I am not sure if it disqualifies to be able to a permanent residence?

Any help would be greatly appreciated.

Where did you marriage taked a place ? When did you enter uk?
Be awar that lituanian nationality not dual nationality country
in lituania the law does not allow the lituanians have onether nationaility so ur wife wont able to be bc if shr wish to keep her lituanian nationality
there is diffrence between pr and indinfinate
pr belong to eu law
irl belong to uk law
both of them lead u to bc after one year
pr £65 no need to life in uk tesr
irl over £1000 nd need life in uk test
i would prefer secuire with indifnate more than pr

Hi Maxmelion
Thanks for your reply.
We got married in UK in June 2010. I entered in uk in May 2005 as a student.
My wife doesn't mind to keep single nationality. Is there a a benefit of keeping lithuanian passport?

So, i will be applying for PR right? And when I would be eligible to apply?
I would prefer to apply for PR because of the price. Unless there's a real benefit of taking ILR route!!!

Why do you prefer ILR over PR?

What my wife should apply to get BC ? Can we both apply on same application?

Thank you for explaining...
Just need a bit more clarification.
So, what you are saying is, for my situation, if we apply PR separate then we can do it in 5 years? Right? And it would be through eea route?

And if we want to apply together we both have to wait 6 years?

If ur wife was 5 years continuos excerising treatty right for thr past 5 years and u the same u can both of u apply same time with same involop for pr if u got full evidence requirments from ukba
OR
after 6 years both of u can apply for bc same time too but thts gona be a big risk bcos u will pay over £1000 each .
nxt month i will complete 5 years but i will apply for pr then after it one yeat will apply for bc

Thanks Maxmelion.
You have been really great help. :D
Yes, we both have been exercising treaty rights for last 5 years. I am as a family member of EEa and my wife as EEA member continuously working for last 5 years. So we are planning to apply in August when my wife's 5 year will complete.
Final query, if we apply together, do we use same application form or we have to use 2 different application form? And is this the form we both use? https://www.gov.uk/government/uploads/s ... _04-15.pdf
