There is a five year qualifying period. You need to be "legal" at all times in that five year period when in the UK.

So it really comes down to this. Were you "legal" from when you arrived in 2001? Or did you only become legal when you were granted your ILR in 2002?

Can you please explain the basis of your UK immigration status back in 2001 and 2002? For example, did you claim asylum? If that is the case then did you claim asylum immediately after arrival in the UK, or sometime later?

900 days? Surely a 5-year period will have 1826 or 1827 days?

Thanks John
I arrived in early 2001 and was legal until I applied for asylum and was duly granted in Jan 2002. Sorry the calculation for 5 years was to be 1900 days approxmately :D :D :D
So suppose as in my case I applied seven months after my visa had expired does it still change or does it have any bearing onn my days

One of the requirements is that you should not have been unlawfully in the United Kingdom at any time in the five year period.

If you were an overstayer then you were not legally in the UK. So can we get this straight? Is it the case that you had a valid visa, that expired, and then 7 months after the expiry you applied for asylum? Is that how it was? If not please do correct.
