My wife and I are considering applying for immigration to Canada. I have done the skilled worker test twice once with my wife as principle applicant and once with myself, we passed both times but she has more points than me. Does this make any difference ie. does the more points you have give you a better chance of getting immigration.

My other main question is that as long as we jump through the various hoops successfully as in the test, money in the bank, interview, medical etc can they just refuse to give immigration - I am just a little concerned about handing over 1100 CAD for the application and not getting anywhere with it. Don't get me wrong I am not expecting a completley smooth ride it is all bound to have its problems I suppose I am just looking for a little reassurance.

1. Only one of you can submit an application as the primary applicant - the other should be included as a dependent.

2. On paper go with the higher scoring spouse as the principle applicant. Why you ask? Under the new Immigration Act you must meet the minimum points requirement (currently 67..anticipated by many practitioners to go up to 75-80 around fall) until your immigrant visa is granted. If the min points go up before your application is processed (despite being submitted) then it will be refused. Go with the higher score gives you a better cushion...what are your respective scores?

Only exception (IMHO) - if the person with lower points has better documentation pertaining to (relevant) work experience go with them as the primary applicant.

3. If you meet all the conditions of the skilled class category including both of you passing security and medical checks plus no grounds of inadmissibilty then a visa will be issued - is there a particular concern you have? In my experience applicants will often make errors in their application from not following simple instructions, lack of documentation, misrepresentation especially of language ability etc then blame the visa processing post. Where an application is refused despite meeting the requirements (rare) then there is scope for judicial review.

Thanks alot for that. I have no real concerns at all, I have been in full time work for 9 years and left college with a diploma and my wife has been a teacher for 5 years and obviously her degree, she also has aunt, uncle and cousins living over there so on that basis I think we will go with her being the principle applicant.
