WHV to HSMP

My WHV expires in 04/2008, however the working component (ie the 12 months) may expire shortly.

I am thinking of applying for a HSMP. If successful, what happens to my WHV?

Does the HSMP allow me to work and live in the UK? And how long is it valid for?

What happens to my WHV?

Do I need to apply for another document to stay living in the country?

I know, stupid questions, but as I read more, I get more confused...

Apply for HSMP later this year like 6-7 months to the end of ur WHV, maybe like oct/nov and once u've got the approval letter u have up to six month to get FLR and u can do it 2-3months before ur WHV expires in 04/2008.

While this is a great idea, my current dilemma is that I may have issues with the working component of my WHV.

My visa allows me to live in the UK for 2 years, but only work for 1. Based on working weeks, my working part would run out in late May. Based on days, my working part would run out in late November.

Some say I shouldn't worry and just keep working. But I am unsure who monitors it and if my agency will make an issue with it in May. So far my agent or current employer has made no contact to me regarding my visa.

It is not clear how the Home Office interprets the 12 months... but regardless if my agency stops me working I am in trouble...

I have applied for a EU citizenship, but like most bureaucracies this is takign ages.. and will continue to take a long time...

In that case the only advise is to get ur HSMP ASAP or before May. Sorry, 4got that those who got there WHV after jan 2005 are only allowed to work for 1yr but live in UK for 2yrs. I got mine in oct 2004 just months before the changed the rule and worked for 2yrs.

Your agency might not know but believe me Home Office does and it might affect u if u work more than 1year, cos they have all ur visa records that has been issued to you ever since u've been comin to UK. Called dem few weeks ago and the guys i spoke to listed all my visa (student, WHV etc) since i've been in the UK.

Best bet is to apply now before may and once u get the approval letter, u can switch in-country immediately without goin back to ur home country but just make sure you get up to 75points and PLEASE DO SUBMIT YOUR P60. You can wait till the 2005/06 one comes out in April, since its goin to tbe recent P60.

If I wait after April 1, the costs will go up... plus with the potential admin delays, the time I get my approval, it may cut very fine to my May deadline.

I am aiming to submit my application this month. However will have no P60. I am hoping pay slips, bank statements and official certified income summary from limited company will be sufficient. Unless I can submit a partial tax return?

If you dont submit your P60, ur application WILL BE REFUSED. Simply cos the period u are claiming for should atleast have one P60 or fall within a Tax year. So if u said u are tryin to cut cost by not wanting to wait for the 2006 tax year to finish and get P60, you'll be paying the initial £315 plus the new fee after april and if u dont include P60, it will be refused even if u submit bank statements, letter from employer, payslips.

Read the guidance, it is stated that u have to provide Income Tax Return, which is the P60 and ur payslips. HO/Caseworker is lookin for reason to refuse all applications, so if ur P60 is not there that is a solid reason for them to refuse. But might be wrong, they might accept without P60 but dont think u wanna risk that chance especially if they refuse and ur £315 is gone.

I'm not tryin to be hard or anythin but just think u'll be payin more if u dont wait and submit a P60.

To clarify -

If I hold a HSMP Visa, does this allow me to stay in the UK?

Or does this only allow me to work in the UK. Do I still need another document to let me reside in the UK?

Does my WHV become invalid or can I hold a HSMP and WHV simutaneously?

My WHV lets me stay in the country for another 12 months. If I attain a HSMP now - what happens?

not sure what happens to your WHM after u get HSMP stamped in ur passport. Most likely nothing, and the HSMP will just take precedent.

I have known people who continue to work after their 12month component is over. This is very very risky. Since if they find out, u face instant deportation.

I have heard stories of people who got questioned on their way back into UK form a short weekend away in Europe. They were still working after 12 months. They ran some checks and were deported at the airport.

best thing is apply for HSMP as soon as u get your P60

Like i said b4, HO will know if u are still allowed to be working on ur WHV especially if it was suppose to be for 1yr but were granted 2yrs....as bulldozer has said above.

Try and get the HSMP asap and switch immediately while u still have ur WHV even if ur 1yr working is up, you can still switch to FLR(HSMP) but as long as ur WHV is still valid.

HSMP will superseed ur WHV and yes u can still work/live in the UK. The reason for HSMP is to make UK your new home country (though ur original home country will always be home sweet home).

HSMP is 2years, so u have another 2yrs to live/work in the UK and if u want to apply for extension when its coming to an end, they will extend for another 3yrs and within all those years u shud be eligible for a permanent stay, which will not restrict u to anythin in the UK so no more applyin for further visa to stay

MAKE SURE YOU INCLUDE UR P60 else you'll be risking ur £400. You can get the 2005/06 P60 Tax Year if you can get the recent ones to be issued from this April (2006/07 Tax Year). HO/Caseworker knows everyone workin will be issued one from this month (April), so you can give an excuse that u havent got one. Or get ur applications together and wait till end of the month and if u havent got it, send ur application off b4 ur WHV 1yr is up and as soon as u get ur P60, send it off as additional document.....but that is if a decision hasnt been made on ur application yet.

I will be applying for my HSMP. I will send it off once I have all outstanding documents (which right now is my P60 and several documents from my employment agent & limited company).

My query is if I need anything in addition to the HSMP to allow me to live in the UK. From the above - all I need is a HSMP (which gives me 2 years to live and work).

There is a lot of talk of FLV and EC and I am not sure if I need these documents (now or ever) if I hold a HSMP?

What is a Leave To Remain?

Do I need one if I attain a HSMP Visa, and still have 12 months remaining on my WHV?
