will husband get visa?

Post by mamaolivia » Mon Jul 24, 2006 8:46 am

hi
new on here and just want advice/opinions. my husband and i have been living together overseas for 3 1/2 years and married for 1 1/2. I am british and we have a 1 year old who has a british passport. If i go ahead to the uk and get a job and suitable accom - what do you think his chances would be of getting a visa? If I were claiming working family tax credits would this jeopardise his chances?
is it good enough that he wouyld hope to get work in a factory or whatever or is it necc to have a firm job offer?
many thanks for any help you can give me as is a big decision for our family to make and i dont want to end up in uk for him to not then be able to join me.

Do you have any family members ... for example your parents .... who can act as additional sponsors at least initially? I ask that because if you have then you travelling back first may not be necessary. It might be possible for your husband to make the application for his spouse visa while you and the child are still outside the UK.

Or do you have sizeable savings that will make it clear that no claim for certain Public Funds will be needed by your husband?

You say you have been outside the UK for 3.5 years and ask "If I were claiming working family tax credits would this jeopardise his chances?". Well you can't claim WFTC! But for a different reason! Since you went abroad WFTC has been abolished!

But what will be possible to claim will be for you to claim Child Benefit, and for the two of you to jointly claim Tax Credits, that is, Child Tax Credit, and possibly even Working Tax Credit. Such claims are totally OK and will not infringe the "No recourse to Public Funds" restriction on your husband's spouse visa, when it is issued.
