Will our child get PR when my spouse gets citizenship?

Post by tulips4u » Tue Nov 01, 2011 10:12 am

Hi,
My husband got ILR status in FEb2011 and therefore eligible for citizenship in Feb2012. Both I and my husband were originally on independent HSMP visas and our daughter was my dependent. In April 2011 both I and our daughter became his dependents. Our daughter is 5 years old, was born outside of the UK, but has been resident in the UK for the last 4.5 years.

Our query is: Is our daughter eligible for PR or citizenship after Feb.2012 i.e subsequent to my husband getting his citizenship? Or has she also got to complete 2 years as his dependent before applying ?
Your advise is greatly appreciated.
Thanks, Tulips.

Hi sushdmehta,

Many thanks for your reply.
I had alook at these articles, but I am still confused. My daughter was born outside of UK in 2007, but has been in the UK for the last 4.5 years. However, she was my dependent (on my independent HSMP visa) until June 2011. We both became my husband's dependents on his ILR visa only in July this year. So, effctively, she does not complete 2 years as his dependent per se. Is she qualified for ILR when my husband gets citizenship in Feb2012 ?(before completion of 2 years as his dependent under the category of 'children' ). Please help, it seems an unusual situation, and could not find anything on general guidelines.
Thanks again - you've been extremely helpful many times before as well, much appreciated!

There is no requirement of "being resident / dependant in UK for X years" for a minor under 13.
