Will this jeopardize our spouse visa application?

Post by ZenAssassin » Wed Sep 12, 2018 9:41 pm

Good evening.

Firstly I apologise if this has already been asked before or if I am posting it in the wrong forum.

I am a male British Citizen and my American girlfriend is currently visiting me on the VWP. When she arrived she had intended to visit for a month however she has now decided to stay for longer as she wants to visit Scotland and Wales and do more sightseeing. Her passport has been stamped at the port of entry for 6 months.

She fully intends to return to the US before her expiry date in her passport and will not overstay whatsoever. We are planning on going down the Spousal visa route on her return back home and so we want to follow the rules thoroughly. We are both in our 40s, employed, and each have respective ties to our own countries.

My question is, will her staying beyond the time that was on her ticket, count against us when we apply for the spouse visa? She was asked by an IO at port of entry how long she was staying and at the time she said her ticket was for a month and that was her intention. But life is full of change and now here we are.

Thank you in advance for any advice on this.

As long as she doesnt overstay her visa there shouldnt be any issue.
