What a curious move. I think my concerns are quite adequately expressed on this blog: http://freemovement.wordpress.com/2008/ ... evoked-ii/

The new legal situation is clear madness, and there is going to be a mountain of appeals for the courts to handle. Maybe the goal is to overload the court system, so that people do not bother to appeal anymore? And I thought this was a civilised country.

Of course the other side of the coin is that DP3/96 also specified when removal actions can proceed. Is that now covered elsewhere, or did they just create a legal vacuum?

They have additional guidance and new procedures, and are getting it cleared for publication. It will be on the BIA site in due course.
