Withdrawal of judicial review and making new application

I have an urgent query if somebody can reply please...
I got Student visa till 31 May 2011 and did my MSc,
I obtained Post Study Work visa from 12 July 2011 to 12 July 2013.
I applied for Tier-1(Entrepreneur) visa on 12 July 2013
Tier-1 visa application was refused on 24 December 2013
I went to appeal in FTT and UTT, but unsuccessful.
on 15/06/2015 upper tribunal refused permission to appeal in upper tribunal.
I have submitted application for JR in June 2015
I want to withdraw my JR and want to make fresh TIER-1 visa application.
My question is, am I eligible to make new application at this stage??
your response will be highly appreciated.
