Work 14 days after CoS expiry date

Hello,

Could someone advice please. I am currently on Tier 2 ICT visa. My CoS dates are 6/01/2014 till 5/01/2016.My current visa expires on 19/01/2016 which is 14 days after my CoS expiry. My husband had an ICT dependent visa with the same dates.

My husband got a job and his new employer issued him a CoS starting from 19/01/2016I would like to continue working for my current employer but under the Tier 2 General dependent visa covered by my husband's CoS. Will I be allowed to continue working for my employer between 5/01/2016 and 19/01/2016 or I will have to make a 2 weeks break?

As long as you apply to extend (change ) your visa before the visa expiry date, you should be fine to carry on working.

My husband does not extend or change his visa. He has to leave UK and go though new entry clearance.
What exactly give you a permit to work CoS or Visa?

Visa. When you submit your application to switch to T2 Dep, your current leave will be treated as continuing under 3C leave.

i'm assuming that you will apply to switch to your husband's dependent from within UK. Point to note - Holiday season (December) is approaching and the backlog at embassies will go up. Since your husband has to apply for entry clearance, he has to go back to home country, get an appointment, submit the application, wait for the visa approval and then come back to UK. All this has to happen before 19th Jan so that you have enough time to submit your application before 19th. Do plan accordingly.

if you have leave as a worker then you can work until the 19th, because that's what your visa/residence permit is valid until.

The difficulty is I plan to apply for new visa in the beginning of December (hope my husband will receive his visa till that time). I assume my new visa will be given my husband Cos start date -14 days= 19th Jan-14 days =5th Jan. it means since 5th Jan I will be under new Visa and I will not be able to work till 19th Jan because my husband Cos start date is just 19th Jan.

I think my chance is: if I apply for new visa in the beginning of Jan (2th-5th) than I will be under 3C leave rules. That means I will be under my current conditions and be able to work till new visa is given.

If you're on work status now and apply for an extension before your current leave expires you can work until the decision is made on your extension.
