Work Permit Extension - ILR

Hi,

I have below queries regarding my immigration status and would appreciate if anybody can clarify these as I am really confused how to proceed about it.

•I am a work permit holder and My Employer sponsored - 60 months visa .
•The visa was stamped on 2nd December 2007 and My Visa expiries on 02nd December 2012.
•I entered UK on 15th March 2008 so I have a gap of 3months and 13 days from 5years of continuous leave in UK.
•I am with the same employer, with the same job and with bit more salary up until now.


My questions are ,

•whether I will be eligible for applying ILR after my visa expires as I have a gap of 3months and 13 days from 5years of continuous leave in UK, If not what options have I got for applying ILR.
•My current employer does have any issue with extending my visa but they don’t have any sponsorship licence as it is expired and they didn’t renew it.
•My immigration status is coming under un-restricted COS.

Hi,
I am in a similar situation - I am 3 months + short for the 5 years.. so just applied for extenstion under Tier 2 (unrestricted COS).. You cant apply for an ILR with a gap of 3 months..i confirmed this with Home Office..

Conicidentally, even my employer didnt renew his licence.. we contacted HO and it was reinstated within a week..

The main issue now my salary for ILR..they are proposing £31k which I am short.. not sure this will affect us..
