work permit refused

Hi,
My employers application for a work permit was refused cos of the following reasons;

. In this case you have used a generic based advertisement, which does not conform to the above guidance; we are therefore not able to approve this application.

. In this case, no national advertising has been undertaken. Neither has any other suitable recruitment method been used. You have, therefore, not demonstrated that a resident worker cannot fill the vacancy and we are unable to approve this application.

I saw the vacancy on the internet and went through different interview stages before being offered the job. My question is;

with the reasons given above do I still stand a chance if I appeal or re-apply?

I'm afraid it's not for you to appeal or reapply, it's for your employer to do that. Only they can apply for the work permit.

It sounds like they have not prepared a proper work permit application.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

was the copy of advertisement submited with the application? did your employer applied directly or did they use a consultant or solicitor?
