Working during appeal

Can any one suggest me... my visa expired when i sent it for switiching to Tier-2. Now I got refusal for which i am appealing. I am just wondering can i work legitimately when my case in pending for appeal?

That would depend on whether your existing leave (which continues if you submitted an in time application) allows you to work.

When did it expire? Before or after you submitted you application?

My visa expire after i applied for switching to Tier -2. Thanks for your prompt response mate.

The following would need to happen in order for you to be able continue working for your employer.

1. You mush have indeed submitted your Tier 2 application before your Tier 1 PSW visa expired.

2. Upon refusal of your Tier 2 visa, you lodged an appeal application to contest the decision within the time required. I believe this is about 10 days (I stand corrected).

If you satisfy the above, you are allowed to continue working in the UK under Section 3D pending the decision on your appeal application.

Yup 10 days is correct.

It was hard to convince HR that I can work legitimately when my appeal is pending..pffffffff
