Working Holiday Visa Help Plz !!

Post by wayneo » Tue Mar 25, 2008 7:45 pm

Hi

i need a little help here as im going a little loco over this

i recently had a stupid friend who came up with the drunken idea of helping ourselved to some beer from behind a bar whilst out one night
i being a sheep followed (stupidly i know)

i subsiquently got caught and the police gave me a caution for (burglary) believe it or not, when you are trespassing behind a bar it is burglary

i am absoloutely devistated about this as i was planning to immigrate in jan 09

what is was wondering is if anybody knows what my chances of securing a working visa are!

one point which may be my saviour is that when i was young i was allways known by my fathers surname which lets say was smith

and this is the name the police have for me!

although my name legaly has allways been my mums maiden name as they where not married so lets say that is jones

i have a national insurance card which says Smith on it, although that is the only thing linking me to that name

does anybody think applying in Jones and not mentioning this record would be a good idea, not so sure if im keen on it though

any help is greatly appreciated

thanks in advance =)

.

It would be a Bad Idea to create any documents that would show any attempt at deception. Deception by omission is still deception, and that will cause you great regret down the line.

On most visa applications there will be some question about your personal criminal record. The question won't be under which name you gave the police ... it will be about you.

The fact that you didn't use your legal name at the time of your arrest/citation probably wasn't much brighter than the original offense. An old wisdom to consider: the cover-up is usually a worse crime than the offense one is trying to hide.

What name is on your passport / WHM visa ..?

Have you had your court date yet ..?

What determination(s) were made ..?

Have you established legal assistance ..? Maybe you can get the charges greatly reduced or thrown out. THAT would help immensely.

A little bit of disorderly conduct or public intoxication would be VASTLY easier to work with throughout your life record than burglary. You will find yourself explaining that burglary charge over and over ... when you are lucky enough to be asked about it. In many cases you will not be given a chance to explain.

[ On EDIT :

Have you approached the bar and asked if they would be willing to accept a plea down to a much lesser charge ..? Perhaps you can offer to cover their expenses and inconvenience ..? ]
