Workpermit.com HSMP self assessment - criminal conviction

Post by niw2 » Sat Mar 15, 2008 9:02 am

The HSMP self-assessment form on Workpermit.com states that a person is not eligible for HSMP if he or she has a criminal conviction. Does anybody know whether this is correct?

I hope to apply for HSMP/Tier 1 on 1 July 2008 from New Zealand. By that time, it will be five and a half years since I was convicted of a traffic offence. I am concerned that my application may be automatically rejected because of this conviction.

.

"Criminal conviction" is generally more serious than a traffic offense.

Unless, of course, the traffic offense was quite serious, such as grievous drunk driving, reckless endangerment, manslaughter, etc.

I suppose we should make sure that section is much more clear ...

Do you mind explaining your traffic offense in more detail ...? Include any related circumstances.

I think members here could offer good advice on how serious it is and if it would prevent an HSMP from being granted.

these are the guidelines regarding convictions when applying for settlement. i suspect it will be similar for visas as well. see if this link is useful http://www.bia.homeoffice.gov.uk/britis ... character/

Thank you both for your replies.

1. The conviction was "drinking and driving causing injury". The circumstances surrounding the offence was that, when I was a student, I foolishly drove the morning after a party and fell asleep at the wheel. A crash resulted. A subsequent blood test revealed that I was still over the limit.

2. I was fined and sentenced to community work. I note from the link provided above, the rehabilitation period for such an offence is five years. By the time I apply in July 2008, it will be more than five years since my conviction. Hopefully this means that my conviction will have little effect on my application.

Any further advice or confirmation from other members would be appreciated.
