2 year condition for spouse’s ILR

Post by rohitktm » Tue Aug 31, 2010 12:11 pm

I have 2 questions regarding spouse’s ILR

1. She was student for one year and had her independent student visa during that tenure. Later she transferred to Tier 1 dependent. Will her student visa period (1 year) be counted for 2 year residency in UK?
2. Is 2 year required to be continuous? Or it can be sum of stays during my 5 year ILR qualifying period? i.e. 1 year 3yr/total 5yr year and 2nd year in 5th yr /5th year?

Many Thanks.

1. No. Time spent in the UK as student does not count towards settlement, unless settlement is applied under long residence category.
2. Continuous.
