Please I need an urgent advise. I want to apply for ILR this week based on 10 years long residency.
My immigration is as follows:
I came to UK in September 2010 as a dependent under my partner who is on teir 1 visa. In Feb 2016 we applied for ILR and the ILR was refused in September 2017. My partner ILR was refused and mine was also refused since I am a dependant on my Partners visa. Within 14 days of the refusal my partner applied for ILR based on 10 years LR while I applied as a dependant based on family life. My visa wanted granted and I was granted 30 months Limited Leave to Remain.
When I made my ILR application in Feb 2016 my visa was due to expire 25th March 2016 and the application was refused in September 2017. I believe I lost my 3c immediately my application was refused but I made further application within 14 days of refusal and the new application was granted in January 2019.
My question is that based on my history does the[ Hoque & Ors Vs SSHD ]Case law covers me?
My immigration history apart from this gap is very good. I do not have any other issue apart from this gap that happened when my application was refused in 2017 but with further application granted I wanted to know my chances and getting ILR.
