4 to 5 year rule

i have a valid HSMP to 2008 dec this wold be a total of 4 years since i am on hsmp at the end of this period am i eligible to apply for PR or do i need to further extend the HSMP for another year before applying for PR. have they applied the 5 year rule retrospectively as well?
