5 year spouse visa changed to 10 years when to apply for ilr or long residence

Post by Zohibh123 » Wed Oct 09, 2024 4:48 am

Hi thank you all for taking the time out to view my post.

My wife was granted an initial 5 year spouse visa however after the first extension we were put on to the 10 year route. She has been in this country UK now for 7.5 years on 10 year route and 2.5 years initially on 5 year route.

My question is since she has been here continuesly for 10 years with no gap can I now apply for her ilr via the long residence route or do I have to wait another 2.5 years for a full 10 years on the 10 year route before I can apply?

Also the long residence route says I should not use it if she's here on the basis of family life. Does this mean I have to fill out another form and if so which one?.

She's been here 10 years in total now just initially on the 5 Yr spouse visa (2.5 years then changed to 10 years) and changed to 10 years for the remainder period.

Any help would b much appreciated as I'm kind of doing this alone without a solicitor because I can't afford the additional cost. Also I've had a look at some other posts but can't seem to find a definitive answer.

Thank you all in advance

Regards zohib

If that is the case - yes.

No. It's meant to distinguish between FLR(FP) and FLR(LR) I suppose. Use long residence form.

OK great so I just apply for the long residence route not the family route right. Also the fact that her she spent 2.5 years on the 5 year route is irrelevant then?

Thanks for the prompt response much appreciated
