My PSW visa is expiring in March 2012, which will be exactly 10years that I have been here, but in Nov 2009, I was refused for not having sufficient funds for the 3months continuously. I was given the right to appeal which I did and went to court in jan 2011 but left the counrty without an outcome. I returned in march 2011 with a PSW from my country, then saw the outcome. The decision was not overturned but was given another right to appeal to the high court. Will the period of me going and returning be considered a break in the 10years lawful stay and if so will I be able to make a case using the Pankina Judgement?

Someone please help! :(

Your leave continued under Section 3C until you left the UK. If you were away for less than six months in a single absence and less than 18 months in total within ten years, etc., then you should meet the Long residence  (276A - 276D) requirements.
