7 Years on student and still wanting to do a 3 years PhD

Am finishing off my MPhil programme this December after which I will have clocked 7 years on student Visa. Since MPhil is a research programme, do I qualify to enrolL for a 3 years PhD programme after Dec.-will UKBA grant me Visa to study PhD? Please kindly advise.
