Child born outside UK to ILR father

Hello All,

Can someone please confirm if my child is born outside of UK will he automatically be eligible for UK citizenship as it would be if he was born in UK? I am currently on ILR and my wife is PBS dependant.

You can apply for British Citizenship for your child on MN1 form, It is Home Office descretion to grant the application. Your child is not entitled to it. However It is very unlikely that Home Office will refuse the application.

No he will not be entitled to register as British if born abroad to parents who were not British. The child would need to return to the UK then wait until such time as s(he) is able to apply using discretion.

Could you please suggest that I am eligible for my naturalisation and if I get my citizenship before my kid is born(my wife would still be pbs dependent though), would my kid if born abroad would be automatically be entitied to british citizenship?

If you were naturalised before the child was born and that child was born abroad s(he) would be British by descent.

Thanks a lot Amber, that was really very helpful. Just to re-affirm only if one of the parent was british that would suffice my child to be british by descent, its not deemed necessary for both the parents to be british correct?
