ILR Qualifying period calculation

Post by harsha1415 » Mon Jun 13, 2016 2:01 pm

hi

i would like to ask about my ILR qualifying period, actually i have switched from PSW to tier 2, but actually my PSW expiry date was 14th feb 2012 and i got sponsor certificate dated 1st Feb 2012 from my employer. i have made tier 2 postal application using the sponsor certificate on 10th Feb 2012 and i got visa with BRP issue date as 20th May 2012. i have renewed my tier 2 visa on 20 Dec 2014 and now i got visa until 20th Dec 2017.

i would like to ask whether i can eligible to apply for PR on 10th Feb 2017(based on date mentioned in 1st sponsor certificate) or 20th May 2017(based on BRP date of Issue)

Could you anybody please answer to question

Thank you

This one. A CoS does not mean you have been granted a visa.

Applying for Tier 2 ILR with dependent

Post by harsha1415 » Thu Dec 08, 2016 3:41 pm

Hi

currently i am on Tier 2 General visa since 14th May 2012 and my current visa expires on Dec 2017. But i will be eligible for Tier 2 ILR on 1st of May 2017 (after 5 years continuous period). My Wife is also currently on Tier 2 dependent visa due to expire on Dec 2017.

My first question is do i need to apply ILR visa (May 2017) along with my wife as dependent or can i extend my wife visa separately in December 2017 after i got ILR.

second question is if i extend my visa on Dec 2017 , is there any problem for her continuous period of 5 years for the eligibility for ILR in future

Please help me
thank you

Please keep your ILR questions in the ILR sub forum and not the Tier 2 General one.

When did you wife apply and get entry clearance as Tier 2 Dependent?

Are you applying for ILR based on Tier 2 with 5 years residence or ILR based on 10 years long residence?

Hi

My wife got entry clearance as Tier 2 dependent on 1st June 2015 and it is due to expire on Dec 2017

i am going to apply for ILR based on Tier 2 with 5 years continuous residence (5 years in same company without any break)

Your wife can continue to extend her Tier 2 Dependent visa until she meets the 5 year residence requirement for ILR. She will need only 1 extension which will be for 3 years.

Correct, she should apply shortly before (within 28 days) of her visa expiring.
