Applying ILR for child Seperately

Hi,

I am planning to apply ILR for myself and my wife first and once we get ours approved planning to apply for my daughter after that. I am using SET (O) form for my ILR and I have Tier 1 General visa currently.

I have following questions

1) Application form for my daughter will be SET (M) ??
2) Can I apply ILR for my daughter before I receive my BRP cards or should I wait for it to receive and then only apply it?

Appreciate any inputs on the queries above.

Is there a specific reason you don't want to include the child with your application?? Is your child in the UK with a valid visa??

You say Set(O) so I am going to assume that you are a PBS migrant. Set (M) would not be appropriate for your child anyway.

Hi CR001,

I am kind of taking a chance with my ILR and if I get it successfully I am going to apply for my daughter and if I am unsuccessful then I wouldn't be able to apply it anyway. I am minimizing the risk I am taking at first shot. If I lose my application I will lose a lot on visa fees.

Regarding my status yes I am here on PBS migrant. my daughter is in UK and she has valid Tier 1 dependant visa valid until June 2017.

Will it be a problem if I apply for her separetely?

Why is that?? What is the start and expiry dates of your T1 visa?

If your spouse is a PBS dependent, she won't get ILR either. So why not just apply for yourself if you think you are taking a risk, then if you are successful, apply for your spouse and child on form Set(O).

Hi CR001,

The chance I am taking is with my wife's application. My Tier 1 visa start date is Dec 2009 and currently have validity till June 2017. I am eligible for ILR and my wife have been in India for one of her renewals so I am taking a chance with compelling & compassionate reasons for her ILR. if she doesn't get it my daughter also won't get it so splitting up their application.

What are the dates of all the visas she has held - start and expiry dates?
What are the dates of her absence from UK?
How old is your daughter and what are her visa start and expiry dates?
When did your daughter first arrive in the UK?

Set(M) is NOT the correct form for dependents if they are on PBS dependent.

Hi CR001,

I have successfully applied ILR for myself and my wife we have got it :)

Now the question comes on what should be the application form for my daughter. She is currently on Tier 1 Dependent visa. I am confused whether it will be SET O or SET F application form. Already quite a few people are on the same boat like me in this thread trying to confirm the application form and it would be great help to find it.

I just confused when I called the home office they said it is SET O form. I think I will go with SET F application form and hopefully it should be okay.

Any idea do we need to have bio metric card for the parents or just the approval letter should be enough?

You will probably need biometric cards and passports. The forms will list what you need to send.

No I am planning to do it in PEO. I have the passports and approval letter with me. Should get the biometric card within the next 10 days, if not then want to apply it before the fees increase by April 6th.

You will most probably have the BRP cards before the fee increase, other the ILR letter should be sufficient. Have you booked a PEO appointment yet?

Availability of PEO appointments will be very limited with people booking and applying before the fee increases. I would suggest you book the appointment sooner rather than later.

yes was just checking the slots when I replied earlier. Will book the slots this week and keep checking throughout the week as well.
