Need help applying for ILR 10 year base

Hi I am going to apply my visa on 10 year long residency base. I'm legally lived in Uk during my 10 year. I just want to ask couple of questions about my ILR application. I came to uk first as a student visa in 12th September 2005. I am on student visa till april 2010 after that I am on Psw visa till 2012.

1. In 2011 I was applied my visa under Tier 1 general and wait too long to get my visa. In December 2012 I got refusal letter from home office they give me a appeal. I appealed against their decision in January 2013 and at end I won my appeal in end of April. Finally I got my tier 1 visa in January 2014. I want to ask you about the period between 2011 and 2013 still counted as legal stay in the uk and this period effecting my ILR application or not
2. I am on under tier 1 general visa but did not work with the same company and didn't get enough salary which is I mentioned in my tier 1 application
before.Is that make any issue with my ILR application?
3. What documents I need to attached with my ILR application?

1. Yes, No.
2. Are you saying that you now earn less than what you were earning when you applied for Tier 1 (General) extension? If so, it is no relevant - you are applying under LR.
3. Read SET(LR) form and guidance notes.

2. so that means I don't need to show them my tax documents???? currently I am earning under £20000 with my new employer but when I was applied for tier 1 general in April 2011 I showed them £37000 with different employer... Please explain

3.I had all the previous passports and stamp visa's, what else I need?

1. Covered by Section 3C leave.
2. Where did I say you will or will not be asked for tax documents? I said that what you were earning at the time of Tier 1 (General) extension has no effect on your settlement application under LR.
3. Same answer as before.

Yes, you can apply at a PEO/PSC.

thanks again for your quick reply just few more question to ask.

1.I understand that in the 10 years long residence you can only be absent for a maximum of 540 days in total. Also you shouldn't be out of the country for than 6 months at a time. I was away from UK 430 days during my 10 year time. At once I was absent from uk 179 days between June 2010 and oct 2010. Just want to ask you shall I need to provide evidence of my absence?


2. my tier 1 visa will be expired on 2/01/2016 and my wife came to this country 27th Nov 2014, she got visa till 2/01/2016 did She can apply her extension with me or she have to wait until I got my ILR ? and please explain what category she is allow to apply her extension and when?

Your passport will have entry/exit stamps, which would be enough.

There is no requirement to submit a cover letter. The application form asks for all the relevant details you need to provide.

I also think, no need for a cover letter if you do not have any issue which need an explation. In my previous visa, I never submited cover letter however previous visa was not for ilr.

There is no IHS for settlement application.
Check if you need to pay towards your healthcare in the UK wrote:You don’t need to continue if you’re applying for a visitor visa, or indefinite leave to remain (ILR).

Hi Respected Memeber,

I booked my PEO appontment next month of 14 Sep, could you please let me know shall I have to explain about my absence outside of uk during my 10 year time in UK?? Shall I have to prove them and explain them why I was away during that period of time or I need to write everthing in my cover letter? my absence record are as under:

1) 16-11-2006 to 08-01-2007 (54 Days)
2) 02-07-2008 t0 07-07-2008 (06 Days)
3) 16-01-2009 t0 30-02-2009 (74 Days)
4) 28-6-2009 to 19-07-2009 (22 Days)
5) 27-11-2009 to 20-12-2009 (24 Days)
6) 07-06-2010 to 19-10-2010 (135 Days)
7) 28-02-2014 to 22-05-2014 (84 Days)
8) 03-10-2014 to 05-11-2014 (34 Days)

Please let me know I am not in trouble with this absence record. I am applying in 10 year base.

Have you made an effort to read the Long Residence guidance, or SET(LR) form or SET(LR) form guidance?
Does any of these mention that applicant is required to submit "explanation of absences from UK"?

I have got couple of more questions to ask regarding my LR application form.
Q1. I have already paid the P.E.O fee, Which is £1900. Do I need to fill the First page of the application which is Section A -Payment details A-1 to A18 ?

Q2. In last Five years I have Changed 4 different address in the UK, and UKBA already has record for my all Previous all addresses. But in the application form there's only availability of two addresses, where I need to provide them in 4 Addresses all together. shall I attach extra page same as page 8 in the app.form.

Ans: ?

Q3: In Absence period of time, I was back home for 133 days (08-06-2010 till 18-10-2010). Do I need
to provide them the proof/evidence or just a written reason ?

Q4. D13:Please state what ties you have with:

• The country where you were born.

• Any country whose nationality you hold.

• Any country where you have lived for more than five years.

You should tell us about any family, friends or other connections with that country.

Country Social cultural or family ties

Q5. Section 3: What can I write in this box ? or is that important to fill this box in ?

Q6. Basically I have done my masters degree from Uk's Uni, and I passed my Life in the UK test last month aswell, Do I still need to fill 3.3, 3.4, 3.5, 3.6. ?

Fill in this part of the form to help us make sure that we have received your documents and to keep a record of them while they are with us. At "A", tell us how many of each of the listed documents you have sent with this application. Q1 - no, you don't fill it in because you have already paid. Make sure you take your proof of payment email with you.

Q2 - Use an extra sheet of paper if there is not enough space.

Q3 - Just write the reason. You have already been advised that reasonable absences do not require an explanation.

Q4 - Only you will know the answers to the questions. It is not a trick question, just answer them truthfully. The questions are self-explanatory. For example, what family or other ties do you have back home, what is your current nationality, where were you born.

Q5 - Not sure if needed.

Q6 - No, not relevant as you have a UK degree. If you have not done an English B1 test then you don't have the detail to complete 3.3, -3.6.

Q7 - List B you could list your UK degree certificate that you submit.

I am going to PEO for my ILR, and I have paid £1900 already from my Bank Card and filled my application form I just want to ask you guys a question about in Section A -Payment details questions A-1 to A18 I don't need to fill but should I still need to add these pages in my application form and the photocopies of these first 5 pages of section A, as well, looking forward to see your kind replies and advise.

I am going to PEO in next few days and I have done the same ..leave the payment page blank but attached photos(name written at the back of each photo) in a mini plastic envelope and fee paid confirmation page placed on top of application form
