British Citizenship by Descent as an Adult

Post by lelichauer » Mon Apr 20, 2015 11:46 pm

I am a USA citizen. Born in USA to an American father and British mother. Trying to figure out if I can return to the UK as a citizen by descent to be with my mum.

Facts:
Born in 1991
I'm over 18 years old
My parents were married at the time of my birth
My mother currently lives in the UK

I am finding contradicting things online and would just like to be pointed in the right direction.

Read this today:
According to Wikipedia (which isn't always reliable) "Those born abroad to a proven British father before or after 1983 or born after 1982 to a British mother need not pay any nationality registration fees, undergo a good character check, or attend a civil ceremony as they are considered automatically British and can apply for a passport directly through the Identity and Passport Services "

It can't be as easy as applying for a passport, can it?

Any help would be greatly appreciated! Thanks!

Yes, just apply for a British passport.

Someone said I had to have done it before I was 18. That I don't qualify as "citizen by descent" since I'm over 18. But I can't find anything to support that.

If your mother was born British and born in the the UK, then you were born British (by descent). You being over 18 won't change that.

Was your Mother born in the UK or naturalised as British?

There isn't anything to support that, as it's untrue. Petaltop is correct. You didn't need to do anything.

Hi, can I check that this information is correct as I'm in a similar situation.
Born in Netherlands 1994,
British father married to American mother,
I have an American passport and British birth certificate,
I have been resident in India but am now in uk on American 6mnth tourist visa,

Can I apply for dual British/American passport ? If so what is the process I have to follow ?

Thanks
