Baby Settlement Visa - Immigration Health Surcharge ?

Hi All,
Me and my wife are on ILR since last 18 months.
I am applying for kid's settlement visa who was born in India on Oct 2014. I have below key questions

1) As per revised rules 6th Apr 2015, do I need to pay for Immigration Health Surcharge?

When you need to pay
For visa applications made outside the UK, you’ll have to pay if:

you’re a national of a country outside the European Economic Area
you’re applying for a visa to work, study or join your family in the UK for more than 6 months (but you’re not applying to permanently remain in the UK)
you’ve applied and paid your visa fee on or after 6 April 2015


2) Baby passport will get expired in 5 years time. What is visa expiry ?

3) When we can apply for British Citizenship?

Hi ,

Even I have same issue. Me and my Wife got ILR in Feb-2013. My Wife delivered a Baby Girl in Dec-2014 in India and I am planning to bring my Daughter to UK.

I would like to Know following things.

Do I need maintain any funds in my account before submitting the application?, if so how much and for How long.

I am living in single Bed room House. I would like to Furnish the same house address in the application. Does it become a problem? Do I need to live at least in a double bedroom house to bring my 4 months old daughter?

Do I need to pay Immigration Health Surcharge for my new born Daughter?

Please help me in this regard.

The NHS surcharge is payable for all new entry clearance visas. It is payable upfront at the point of application and is £200 per year payable for the full duration of the visa validity date.

If both parents have ILR, then baby should be granted ILE for the duration of the passport. Try asking for a refund, if baby is required to pay.

Although an entry clearance for ILE has an expiry date, the leave to enter the United Kingdom is granted for an indefinite period.

So, perhaps 3(1)(a) may not be applicable, as 38(2) doesn’t apply.

Moreover, Who does not need to pay or get an IHS reference number

You’ll be able to use the NHS without paying the surcharge or getting a reference number if:

you’re applying for indefinite leave to enter or remain

Hence, I think that it's worth questioning the requirement to pay the IHS or subsequently requesting a refund, saying that 3(1) is not applicable.

Thanks for your posts. I am bit confused now. If IHS is required to be paid for settlement Visa, How much do we need to pay upfront? My ILR and my Wife ILR is valid till Feb-2023 and my Daughters Indian passport is valid Mar-2020. On what basis IHS fee would be calculated for my Daughter settlement visa?

They may try to use the expiry date of the ILE.

As per me, fee for dependent is 200 gbp (if you are applying for ILR, it's not required)

I have used IHS Alpha service to understand status and outcome was more confusing

Based on the information provided we have calculated that your total Immigration Health Surcharge is

Exempt based on child in care question

I think that it should be £0, if granted ILE.

Once ILE granted, request refund to UKVI?

These are the details I entered into the application.

Given Name -> xxx
Family Name -> xxx

We finally entered into "Application Summary"
Are you applying to join or remain with a person already in the UK?
Add their details
You don't need to add this person's details if they are a UK or EEA citizen, or they already have indefinite leave.
--> I didn't add my details because of the above mentioned reason .

Proceed to payment and after the conditions agreed it displayed Rs.60,000.00.

I thought ILE shouldn't be paying this amount. Let me know, from where did you get £0 for your application. I shall try that and take the print out and submit with my application.

I have paid 60K INR and my baby visa is arrived today.
it took around 35 days and valid for 33 months.

Recently my baby got a visa for 33 months. Category is stated as 'Settlement to join parent(s)'

Travel document letter states that you should travel within 30 days otherwise your visa will expire and you need to apply for replacement visa.

Can I request to advise on
1) What is this replacement visa?
2) what are impact if we travel post 30 days?
3) I have applied for British Citizenship. When can my kid is eligible to get BC?

Assuming that child was born outside the UK, they also expect both child and child's other parent to have ILR/ILE at the time of child's registration application.

As your child was born abroad, it would be when the other parent is naturalised.

Broadly, children born abroad are in-line with the most restrictive parental visa.

The entry clearance is only valid for 30 days and will expire after 30 days. If you travel past 30 days, you would have to reapply for the same entry clearance.

Was child granted ILE?

Did you have to pay the NHS surcharge?

"Apply for same entry clearance" means go through entire process again ?? Can you provide some links or guidance etc.?

I have paid IHS (NHS) Surcharge of 60K INR

It is visa with 33 month validity and type mentioned as 'Settlement to join parent(s)'
