hi there, i have got rejected my tier 1 entreprenuer visa under the section 322-1(a) , present i have applied for judicial review , and my wife is having working permit ( tier 2 )

so can i have a chance to be her dependent now .
please suggest me

Yes u can

Tier -2 is extendable upto 6 years , to get ILR - u have to switch visa tier-1

Hi,
i am just worried about there would be no rejection in future,if i go for dependant of tier-2.

As in my rejection letter from HO states that i could apply for spouse visa under the paragraph of 281 and 295A of the immigration rules.

Is this rule for ILR and citizenship people.

As they have refused you under 322(1(A)), then it's likely that they will continue to refuse any entry clearance applications under 320(7B) for at least one year, unless exempted.

Unfortunately, dependants of Tier 2 are not exempted.

That's out of date. You may apply for entry clearance as a partner of an ILR holder under Appendix FM (after your partner is granted ILR).

OP, did you apply for Tier 1 (Enterpreneur) leave from within the UK or outside UK?
