Please help with switch to Tier 2

Dear all,
I am in Entrepreneur visa since 2014 and have involved in website business. Its expiring on 2017. I work as director and website designer for my company and give service to one big company.I learn that I can switch to Tier 2 visa. My question is how likely am I to get it switched, provided that the other company is willing to sponsor me with appropriate salary.

The 'website designer' is not Tier 2 National Shortage Occupation List. Does it hinder in anyway for my application?

Is the 'other company' a licensed sponsor?

Is this 'other company' your client?

This other company is my client but it hasn't applied for the license yet. But it may apply for me as I have been with them for long time.

Hi all,

I was going through the policy guidance and learnt that to switch from Tier 1 Ent to Tier 2, the sponsoring company needs to have Residet Labour Market Test, if the job is not on the shortage occupation list.

Has anyone been through this route? How hard is this to convince the UKBA? I would be grateful if someone could share views on this issue.

The company would need to meet the requirements as set out by HO in regards to the RMLT. No convincing, just rule following on what has to be completed if it is a genuine vacancy and no other settled or EU person is suitable.

Thank you very much your view CR002.

Yes I have been with this company for very long (since day 1), I know all the workings of its procedures. I guess this is my plus point to convince the UKBA that its hard for any other to take my position.

BTW dear CR002, do you have any more information about how to proceed like when to dissolve my company, any additional documents I can prepare.

Anything on this subject is welcomed. Sorry, im asking a lot.

Hi
I think you should carry on with your T1 business activities genuinely and as normal, when you are about to apply or applying; till you successfully receive your T2 visa status. You can dissolve and terminate any associated activities then after.
