Information about tier 2

Hi there,

I need your help I was on PSW after which I submitted the application as tier 1 entrepreneur and it got refused now my case is in court of appeal for which I got hearing in Jan 2016. Now I got sponsorship offer from one company and I want to switch to tier 2 sponsorship. Now my questions are if I withdraw my appeal or didn't get favourable response from court I will get 28 days to submit a new application.

1- what will be my status during those 28 days?
2- does my employer have to pass RLMT? If yes why?
3- and will he issue me restricted COS or UNRESTRICTED COS as I am in uk and I will apply within uk?

Please guys I need your help on these points desperately please answer my questions.

2. IMHO, don't think so (assuming you made an in-time application for leave to remain as Tier 1 (Ent.) migrant) - because of the wording highlighted in blue:
