Query Regarding ILR (ICT Route)

Hi,

I am planning to apply for the ILR in Jan’2016 in ICT category. I came to UK in Nov'2009 on Tier 2 ICT and have NOT changed to any other visa category or diff VISA.
I entered UK in 08-Nov-2009 and my travel details as below.

I am having a split as below. Chosen 08-Jan-2016 to have 175 gap, can I go earlier than that may be 6-Jan-2016 with 177 days or it is risk to do so.

Also I might not be able to get the payslip for Dec’2015 by 08-Jan-2015 (attested copy) as it takes some time to get it from my employer. Is it fine to provide the attested copies until Nov’2015 & Dec’2015 payslip without attestation? Will it be alright?

I am applied once in May'2105 and my ILR application has been refused since I have more than 180 days in one year (5 days extra). UKBA has not considered the reason (paternity) as compassionate which I have quoted. Do I need to attach this case details in my current application.

Also is there any minimum salary limit change for Tier-2 ICT route.
