Advice and useful questions to ask when meeting a solictor

Post by RisingSun786 » Tue Feb 09, 2016 7:29 pm

Hey there,

I am new to the forum and wonder if I could get a little help please. A little background first if its helpful.

I'm a British Citizen, 9 months pregnant...due in 3 weeks I married my husband in 2014 but only with an Islamic Nikah - which I understand is not valid as legal marriage document in the UK.

My husband and I will be seeing / meeting a few solicitors before I pop and of course after, just wondering is there anything you guys would recommend asking?

We'd like to know what the best approach to obtaining British Citizenship for my husband is.
Although I am on maternity leave now, there is no issue of showing support as I meet the minimum criteria of £18k but does it affect our case if I'm on maternity leave and thinking about taking a year off work?
In addition to full time employment, I also run a business which will continue to run whilst I'm off.
Does it help our case if I co-own a joint property?

Is there a particular route of citizenship that we should explore that is likely to be more successful?
Are their any particular questions, I should be asking when I meet these solicitors?
What kind of information / financial statements will be expected for me to show other than my salary slips?

Look forward to any advice you can kindly offer.

Many thanks in advance

*A*

What is your husband's current visa/immigration status? Also how long has he been in the UK and what is his full immigration history?

Where did the islamic marriage take place (which country)?

He is unable to apply for citizenship. There is a long and expensive process to go through first before he could qualify.

Suggest you ask:
a) for details of her qualifications & experience in field of immigration law;
b) how to go about making a will, with provisions for both financial & emotional security for your child

Hi everyone,

Firstly, apologies if you have seen a similar question before:

My partner has an asylum legacy case. January 2011 will be his 10th year in the UK.

Arrived on visit visa

Yes totally different you are referring to a dissolved relationship.
Would appreciate removal of that post. Not a great post for husband to view!

When did he arrive in the UK and how long has he overstayed?

Due to overstaying in the UK, he will only be eligible for citizenship 10 years from date that his stay is legalised. The new good character requirement has been made much more strict.

Are you aware that your partner will have to declare any previous marriage for either of you? The Home Office hold everything on record, including all information submitted in your previous partner's legacy application. When you say 'dissolved' do you mean divorced?
As you are already aware, your religious marriage won't be considered as legal under British law.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
