Tier 1 Application for extension under 200k category

Post by Archieuk » Mon Aug 22, 2016 12:29 pm

Hello everyone,

Just a quick question, under the 200k category, should the whole sum of 200k be invested before extension or if it is still in the company bank account for future investment, it is fine.

your views are very important.

Should have been invested, otherwise what is the point of the visa.

Under Tier 1E rules, Invested does not mean fully Spent. There are no explicit requirements in the rules for you to spend all the money before your extension. However simply transferring money to the business bank account with little/no business activity or expenditure surely is not acceptable and leads to rejection (Genuineness test) because you need to invest and run an active trading UK business.
Also not all the money spent in the business is acceptable (e.g purchasing a business from previous owner, your remuneration, property investments, etc) Such expenditures will lead to rejection as the money will not be counted 'Invested'

The money used to invest in property for the business, will be taken into account as investment, but if it is residential accommodation, a surveyor will be needed to provide a value of the living accommodation.

I accept that if the money is in the business account, and activity is taking place, then that will amount to investment.
