ILR 5yrs EEA dependent

Hello Everyone,
Thanks to everyone on this forum. You guys have been so fantastic in posting your various immigration experiences.
My 5YRS ROUTE ILR is 6 months exactly yesterday but I am yet to hear any news from the home office. I submitted through a solicitor who I keep in touch with always. I had a breakdown of relationships with my EEA sponsor but we have 6 years old child together. I was in a full time and another part time jobs for 5 years without a break in employment. Now I applied on my own right UNDER REGULATION 10 OF THE IMMIGRATION EUROPEAN ECONOMIC AREA REGULATIONS 2006.

My timelines are below
SUBMITTED ..........27/7/2016
HO RECEIVED.........28/7/2016
FEES DEDUCTED........01/8/2016
BIO LETTER.............27/8/2016
BIO ENROLED...........06/9/2016

Up till now there is no single email from the HO people. I was not allowed to continue my employment. Because they said they could not confirm my right to work until my application is decided.
Please folks did anyone submitted around July and August last year and if there is any news? Am so depressed and frustrated daily couple with the fact that I haven't been working since 6 months now.
Pls any advice will be greatly appreciated.

Well this is a serious matter. You need to inform Home Office that there will be consequences for them if they cause you to lose your employment.

You must hold them to account.

thanks @ noajthan for your interest. I actually applied for indefinite leaves to remain having spend more than 5YRS in the UK.

@ Obie. My employment was stop since September when my employer found out that my right to work was not confirmed by the home office. It's so hard to be going through this when someone is not a criminal.

ILR is for those on UK domestic visa route who have leave to remain.

If you have (or had) an EU sponsor you are/were on EU route and surely should have applied for ROR or confirmation of PR (PRC).

What application form have you submitted (and what was the fee)?

@ noajthan ... first and foremost I will like to commend you on yoour vast and extensive knowledge on immigration matters. You are a genius and am highly impressed. Are you a immigration lawyer/specialist and can you be contacted personally for immigration matters.

Please pardon my mistakes on the earlier post. I actually applied for EEA permanent residence card 6 months ago.the application fees I paid was £65. I had a breakdown of relationship with my EEA sponsor though we have a 6 years old child together. So I applied on my own right to be considered for permanent residency.
At the moment am very apprehensive because it's 6 months now and am not sure what the outcome of my application will be.

You're too kind. And my only involvement is via the Board.

Your case is a little clearer now.
You can crosscheck and verify your circumstances against HO guidance on ROR cases, here:

Its hard to say but as you are around the 6 month mark you could reasonably expect to hear the outcome soon.

Hi everyone,
Please folks can anyone share their opinion and experiences on when does the actual processing time for the EEA PERMANENT RESIDENCE CARD APPLICATION start.
There are so many conflicting reports about when it actually start. On the HO website it stated that their standard service start when they received the applications and ends when they give their response. As my application is exactly 6 months that application fees was taking from my bank accounts. I thought the 6 months processing time is up and i should be getting reply or outcome of my application but to my greatest surprise, my solicitor told me that the 6 months start counting from when the home office sent out their CERTIFICATE OF APPLICATIONS (COA) and not when they received the applications or taking the applications fees.

Please I will like to know which of the this is true as it's really confusing and most of us in this situation will really like a clarification.

(2) The Secretary of State must issue a person who is not an EEA national who has a right of permanent residence under regulation 15 with a permanent residence card no later than six months after an application is received and the production of—

(a)a valid passport; and
(b)proof that the person has a right of permanent residence.

Hello guys,

Have been reading so many posts on various application routes on this site. Apart from the EU/ EEA PERMANENT RESIDENCE CARD OR RETAIN OF RIGHTS route. Most of the applications requirements for indefinite leave to remain in the UK on the other routes seems to include THE LIFE IN THE UK TEST. But am not sure if it is also included in the EEA/EU PERMANENT RESIDENCE CARD/ROR applications.

I am kind of worried as i didn't submit THE LIFE IN THE UK TEST in my application. Please guys is it necessary to include the test or is the test not required for the EEA/EU PRC/ ROR route. Pleas shed more lights on this.

Also has anyone who submitted their EEA/EU PERMANENT RESIDENCE CARD APPLICATION between August 2016 received the outcome of their applications? The more good news posted on the site gives the rest of us more hope and encouragement.

LIUK test not required for any application (RoR/PR) under the EEA Regulations.

But it will be required at naturalisation for all applicants (EEA and non-EEA), which is not under EU law, but under national UK law.

Hello everyone/ board,

Thanks so much everyone on this forum especially the board for the great work you guys are doing. My EEA PRC application was refused on 15/02/2017 due to lack of evidence though I was giving the right to appeal the home office decision.
I have applied for oral hearing in my appeal form paying £140 as the appeal fees.

Here is the breakdown of my situations. Application was refused on the basis below..

1) I could not provide evidence of my former EEA sponsors exercising treaty right during the qualifying periods.

2) no evidence of livImg together or in a durable relationship with my former EEA sponsor during the 5 years period.

3) no evidence that my EEA former sponsor was exercising free movement in the UK.

The truth of the matter was we actually lived together in a durable relationship with my former EEA sponsor before the end of our relationship in oct 2015 due to domestic violence even till now we still get in touch every now and then because of our 6 years old son. Due to the breakdown of our relationship my formal EEA sponsor refuse to provide any evidence that actually shows that we have lived together for 6 years in a durable relationship and that she has been exercising her treaty right through out all d qualifying period. All my effort and pleas for her to release her own part of the evidence proved abortive. That was why I decided to choose oral hearing so I could make my point clear and let the home office knows they need to investigate more about my claims.

Please I will like to know what is the average time frames for this kind of appeals and what to generally expect from the process. Pls your advice and response will be hugely appreciated.

Any suggestions and advice will be greatly appreciated once again.
