Re: Clarification sought - 2 years PBS ICT dependant + 3 years SKilled Worker

Thanks Simon. I have been told by a lawyer that there is more flexibility for ICT PBS dependant time spent and that it would count towards ILR - Hence I am not sure. Did the intepretation of the rules change recently? Incorrect. No such thing was ever possible. The rules have also been fairly clear...

Re: Sponsor letter - Contents and detail of dates of annual leave

There is no rule that restricts you to only time off within your contractual entitlements, whatever that is. The rules simply limit the absences to less than 180 days within any 365-day period. So I suggest not inventing any rules yourself

Re: ILR skilled worker- need help

You do NOT need any letter regarding your previous position.
All you need to know about the sponsor letter for Skilled Worker route

Only the last payslip is enough, no other details are needed. P60 is not needed!

Re: ILR 28 days vs Application Date rules

SET(O) or SET(M) are simply ILR forms that cover various ILR paths. It isn't meaningful to say they had residence under SET(O) or SET(M). Your dependant held visas under the skilled worker dependant partner route and then switched to the partner of a settled/British person route. Both are partner r...

Re: ILR 28 days vs Application Date rules

Again, extension under SET(O) is meaningless. :!:
Yes. If they secure a skilled worker dependant visa (I think it is possible as per the rules), then they can easily settle using form SET(O)

Re: 10 year ILR - rolling 12 month requirement for absences started before Apr 11

Thanks, yes I see that as well, but wanted to ask if anyone's had a successful application with this kind of profile. The new rules and examples also say the 548 limit doesn't apply if your 10 year period extends beyond Apr 11, but in practice it seems this is not necessarily interpreted by casewor...

Hi Zimba,

Oops sorry, in this case, I will wait till I get my interview results.
You will need to change your sponsor, get a new skilled worker visa and work for the new sponsor for at least a month before you can aim for ILR

Re: ILR Application with only one month extra time

Please refrain from starting new posts for your application. Also, did you read the link I gave you above?
The ILR rules require the sponsor to say that you will be needed for the foreseeable future !!!
If not, you cannot get ILR. Getting ILR is not about just hitting the 5-year mark

Re: ILR for my wife and my child

The ILR requirements for dependants are NOT the same as main skilled workers.
Your employment status is irrelevant for their ILR. Dependents have NO income or maintenance requirement for ILR. None of the issues you raised will affect them at all. Apply for their ILR using form SET(O)

For ILR, visa expiry is irrrelavant. You apply when you qualify and the 28-day concession also applies to ALL ILR applications!

None of those questions are important. They have no effect on your application. Just cover absences within the least 5 years

Re: Time in the UK set(M)

Below message it says. Your application under Tier 2 Dependant Joiner of the Immigration Rules as a dependant of Aravindan has been successful. SET(M) must NOT be used. That is not correct for them. You must apply using form SET(O) as advised. The fact that you are a citizen now is irrelevant. The ...

Thank you so much for your reply. My old account can not be reset so I created a new one and saved my details now. Re: Set(M) Earning based on limited company and cash savings

Assuming child is born abroad, child needs ILR (or 10 years' residence) to be eligible for registration , not for British passport even. Assuming you want child to be British, you need to first register them under form MN1, which takes a while and requires ILR if child was born abroad, as mentioned...

Re: BRP and new UKVI

ILR is permanent status and has no expiry date. UKVI is simply moving away from BRPs to digital status for all. The eVisa system is NOT open to all yet and it is estimated to be rolled out fully this summer. So there is no way to get an account yet unless invited. Wait until you get an invite or whe...
