PBS Tier 1 dependant + FLR (M) = ILR?

Post by dng_131 » Wed Apr 06, 2016 7:06 am

Hello All,

Just a generic question. What if a person was on PBS dependant (Tier 1 General) and then moved to FLR (M)? Let's say PBS for 30 months and then moved to FLR (M) another 30 months.

1. Would this person be able to apply for ILR after 60 months of stay? Or
2. This person needs to complete 60 months under FLR (M) only?
3. Is there any link available which explains the category that you could apply for ILR in above circumstances?

Kind regards,

DNG

It depends when FLR(M) is or was applied for.

So there is no correct answer for a 'generic' question.

HI CR001,

Lets say PBS started from 1st Jan 2011 and held for 30 months so until 30th June 2013.

Then person switched to FLR (M) from 1st July 2013 till 31st Dec 2016. Completing 5 years. (30+30 months)

Then does this person has to renew FLR (M)? Or would this person qualify for ILR?

The person will need to extend FLR(M) and will need 5 years as FLR(M).

It also depends on what application or route for ILR the partner made.

Thanks CR001 for your reply,

It means the first 30 months the person stayed as PBS dependant would not be counted towards your ILR qualifying period.

Thanks CR001. My question has been answered. :-)

On what basis would the main applicant have applied for ILR, 5 years or 10 years long residence? This is important as there are some transitional provisions in place.

Main applicant would apply for ILR on 5 year route followed by Tier 1 general.

Spouse DOES NOT have to apply for FLR(M), which will reset the clock to zero.

Spouse can continue to extend PBS Dependent visa until they meet the requirements for ILR.
