Tier 1 General (Dependant)

Post by rakesh5883 » Sun Sep 20, 2015 12:08 pm

I am in the process of applying for ILR with my family.

Me and my wife came to UK in July/2010 on Tier-2 Visa and dependant.
me and my wife Converted to Tier-1 by April/2011
me, my wife and kid renewed our Tier 1 Visa in March/2013
Now me, my wife and kid will be applying for ILR via Set(o) form

I believe that because our first Tier-2 and the Tier-1 visa for dependant were issued before 9th July 2012, my wife and my kid are eligible for the 2 years route ? I am eligible as i have completed 5 years as above ?

And also - Does this mean I can apply using one one form for both my wife and my kid ?

Can you please help me with this query ? Thanks a lot

Family members (dependants)
Your partner and children under 18 can apply on the same form as you if they’re eligible.

Eligibility for partners

Your partner may qualify if all of the following apply:

they have permission to be in the UK as your partner
they’ve been living in the UK with you for at least 2 years if they applied before 9 July 2012 or 5 years if they applied on or after 9 July 2012
your relationship is genuine
you intend to carry on living together
you’re not using public funds

Yes, dependents only need two years if original entry clearance was applied for before 9th July 2012.

One form - Set(O) - for all of you with you as main applicant.
