ILR eligibility for TIER 2 General Dependents

Post by sk2909 » Thu Feb 16, 2017 4:12 pm

Hi All,

I am on TIER 2 General visa and I am eligible for ILR on September 2017.
My wife came to UK on March 2015 as a dependent and it will be approx 2 years 6 months for her in UK when I apply for ILR in September 2017.
As per new rules I believe dependents also must live in UK for 5 years for ILR eligibility.

My query is - when I apply for ILR in september 2017, what visa can my wife be on?

As she cannot apply for ILR, can she continue on Tier 2 general dependent visa?

But I will move from Tier 2 general visa to ILR, how can she continue on Tier 2 general dependent visa?

I really appreciate if someone can who went through this phase can reply back.

Thanks a lot in advance

If you are applying for ILR based on Tier 2 and 5 years residence, the rules allow her to continue as a PBS dependent.
