BC please help

Hello,

i am non eea (china) national and i got permeant residence card. and i am divorced).

I have 3 kids, all born in UK and before my PR card. can i register them as british citizen now or do i have to wait till i get british passport?

i will be thankful if any one give reply. thanks

Defiantly you can apply for all of your children British Passport directly

When did you arrive in UK as spouse of EEA national?
When were each of your kids born?

Since when did your eea national spouse start living and exercising treaty rights in UK?

Are your kids yours and your eea national (ex) wife's children or are these kids or any of the kids from your previous marriage/relationship?

Will help if you write down everything in a chronological order

Like

EEA nationala spouse start exercising treaty rights in uk.
You arrived as dependant of your spouse
Child A born
etc etc

i came in 2005 on eea dependent visa. (lived with husband from 2005 - 2011)

kids born in UK. 2006, 2008, 2009.


all 3 kids from same partner and all 3 kids is mine

i got PR in jan 2012.

Section 1(3) applications - children born in the United Kingdom to parents who are now settled in the United Kingdom wrote:If the child's parent has become settled in the United Kingdom or becomes a British citizen, the child will have an entitlement to register as a British citizen. This registration would be under section 1(3) of the British Nationality Act 1981.

sushdmehta can you please tell me few more things:

1) do i have to send my non eea passport with MN1 application form?

2) as i told you before i am divorced and my ex husband not able to support this (child mn1) application? so what you think MN1 application will successful without his passport?

1) you need to send your passport to prove you have obtained ILR. You can apply using NCS if you want to keep your documents.

2) Parents consent is not mandatory for UK born children applying for registration.

Same thing. PR/ILR are the same for the purpose of Brtish citizenship applications.

I presume you don't have a PR card but a vignette in your passport (or a stand alone paper) confirming your PR status. You still need to send your passport (or use NCS).
