MN1 - Section 1(3) - Parent's Marriage Certificate?

Looked at the FAQ http://www.immigrationboards.com/viewto ... 55&#592355, which says that Parents marriage certificate is required if child is born before 2006.

However, form MN1 lists parents marriage certificate as required document for child's MN1 registration application.

My child is born after 2006, so is parents marriage certificate a requirement or parents passport with ILR showing spouse's name in each others passport will do?

The guide doesn't list the parents passport with ILR so why are you sending that?

Maybe becuase the guide doesn't cover well all cases (for example applications under section 1(3)).

If child born after 2006, marriage certificate is not required. Only one parent passport with ILR is needed.

MN1 Application form page 30 lists following documents that need to be submitted for child's MN1 registration certificate.

FOR CHILDREN LIVING IN THE UK
• Child’s full birth certificate AND
• Child’s passport of entry to the United Kingdom, and any subsequent passports
AND
• Parents’ marriage certificate or civil partnership certificate
Please note - only include children who are not already British
• If one of the parents does not agree to registration a letter explaining their reasons.
• If the application is being made by a guardian, evidence of their right to do so, such
as a deed, will or court order.

Just trying to find out where does it say on form or UKBA website that parents marriage certificate is only required if child was born before 2006.

I know what the guide says and I ask where it says on the form you need to send the parent passport with ILR?

Also - If the child is not living in the UK, then is marriage certificate not required?

I booked an appointment with NCS and they have requested me to bring marriage certificate. It could be because my wife will not be attending NCS appointment and in that case the marriage certificate is required.

Can anyone share their experience on requirement of marriage certificate at NCS?

So far for all my applications with UKBA from HSMP to Tier-1 and then for ILR the UKBA never asked for marriage certificate. The problem is name slighly differs to what is in the passport (missing middle name).

The child has ILR approved the same time as parents, so UKBA should have all the details of father and mother of child in question in heir database. I am happy to send copies of parents passport (Via NCS of course) but not marriage certificate as name mismatch may delay outcome of application.

Apply using the mother ILR status (proof of marriage is not required).

1) Section 3: Parent's Residence in UK - is not required if application is made under section 1(3) - Can it be left blank?

2) Section 4: Good Character Requirement - is not applicable child below 10 years - Can it be left blank?

3) For referees is there any limit on how long they should have held british passport, before they can act as referee?

4) Q 1.39: Date of parent's marriage: Is this applicable for MN1 application under section 1(3) or Can it be left blank?

1. Yes.
2. Yes.
3. No.
4. If not married, blank. If married, just put the date. Filling in the date doesn't mean you need to provide a marriage certificate.
