Suspended sentences **update**

Following my enquiries, I had the opportunity to raise some inconsistencies with the Home Office. I am pleased to say that the guidance will be rectified in order to bring a 'suspended sentence' for the purpose of Good Character, in line with that for general immigration applications.

That means that unless the suspended sentence is 'activated' it will be treated akin to that of a non-custodial sentence [a 3 year ban]. If you have been refused because a suspended sentence was treated akin to a custodial sentence this should indicate that a reconsideration application would be appropriate, so long as the suspended sentence was not activated. I shall update the FAQ to reflect this change.

You beat me to this as I was tied up and had no chance to check my emails. I have multiple confirmations to the effect too.

Now a few precedents should ensure that this glaring ambiguity will not cost people their due after making huge sacrifices.

Dear Amber,

Please i will like to know where you got your comfirmation of suspended sentence for the purpose of Good Character,in line with that of general immigration applications and another thing is, does it mean a person with suspended sentence after 3 year can now apply for Bristish Citizenship.
