Can we apply "non-acquistion of BC" after registra

Hi,

my baby has been registered as a British Citizen via MN1 route. We have not applied a British Passport for him.

His foreign passport will be expired soon, and we want to renew it for him. I was wondering if we can apply a "confirmation of the non-acquisition of British citizenship" from Home Office using NQ form based on he has not applied the British passport although he has got the "registration certificate".

if baby is British Citizen how can you ask them to say that baby is not BC?with or without passport baby is a BC.

Thank you. The reason I am asking this is because If a baby was born after either parents has BC, the baby automatically become British citizen. But how come people can still apply "non-acquistion of BC" for these babies after born, clearly these babies are BC without British passports.

I believe they can.

A confirmation of non acquisition of BC confirms that you have not acquired BC by registration or naturalisation i.e. have not actively sought a BC. It doesn't confirm you are not British (in case you are British from birth).

So, I can not apply "A confirmation of non acquisition of BC " for my registered baby without a British passport, because he has acquired BC by registration. Right?

Correct.

In any case, if the old country requires such a letter, it's likely that dual nationality is not permitted (or requires permission). Your son probably have lost that citizenship and trying to "work around" the problem is not the right approach.
