my wife went today to our local NCS for her application and was told to wait till May unless she want her application to be refused as she have 3 points on her licence because of using mobile while driving which she got in may 2011 from Court and that is her only conviction ...i was advised by a guru on the forum to explain and ask them to apply chapter 10b on the form AN which i did ...so shall i post it myself or wait ? Please any reply would be much much appreciated especially if someone who have been in similar situation and got approved...

I think I made it clear last time. I told you there was a risk involved when relying on added discretion. You need to re-read what I previously wrote.

No, it's a relatively new provision, it's there to be used, if you are willing to take a risk. You could, if refused, possibly ask for a reconsideration (£80) if by the decision, 3 years has lapsed. Entirely up to you, no one, lawyer or not, should tell you what to do, it's your informed choice. Either wait 3 more months for a more certain (but not absolute) outcome or apply earlier.
