Hi,

Can someone please suggest on the below case urgently? Been to NCS today and they suggested that ILR is required for registering a child as BC. But thought that was not required if one of the parent is british Citizen.

Father is British citizen after 5 year residence
Mother had ILR granted recently. (didnt apply for child thinking my child can be registered as BC directly)
Child born abroad a month before father was granted ILR in UK and the child is currently on Settlement visa which is expiring shortly.

Can i register my child for British Nationality under section 3(1) at Home Secretary's discretion? or does the child need ILR before applying for registration?

If ILR is mandatory for the child before registration, Can you please also suggest how i can apply ILR for my child alone as the mother is already on ILR.

Thanks a lot in advance.

Regards

So, it was a correct decision. Child needs ILR before naturalization. Direct registration is only permitted if the child is born in the UK to parents who later acquire ILR. Could have applied for ILR with the mother but that ship has sailed. Need to apply now using SET(F)

kingascona was successful. However, others may not be so lucky.
