URGENT --- MN1 form - Residence Requirement

Myself and my wife both got ILR last week.

Now, I am planning to apply British registration for my 2 yrs 6months uk born son using MN1 form under section 1 (3)

Looking into the guide and form, there's a residence requirement.
Is this section applicable for my son as he's born in UK and applying under section 1 (3)?

If yes, Also, there's absence details need to be provided.

My son is away for continuous 393 days outside uk, will this be a problem if apply under Section 1 (3)?
Do I need to mention this in the application if I apply under section 1 (3)?

The guide says, the child should not be more than 270 days away from uk if we apply under section 3 (5)

NB If the application is made under section 3 (5), you should also check that the child
was physically present in the United Kingdom or a qualifying territory (see list on page
8) 3 years before the date that the application will be received by the Home Office or
other receiving authority (see page 30 “Where to send the application form”). If this
requirement is not met then an application under section 3 (5) is unlikely to be
successful.
To satisfy the residence requirement under section 3 (5) the child should not have been
absent for more than 270 days in the three year period

Section 3(5) is not applicable, if applying under Section 1(3).

For children born in the UK, there is no residential requirement under 1(3). Only a parent's ILR or equivalent is necessary.

Shall I skip the entire SECTION 2: RESIDENCE [2.1 to 2.4] , leaving this blank?

I think you may just cross out or leave blank or put "N/A to BNA Section 1(3)".

Hi,
Can you please confirm whether you filled in Section 2 for application under Section 1(3)?
I am faced with same question and although I have read in some places that residence requirements do not apply for Section 1(3) I can't find this anywhere in guidelines.
As usual you pay loads of money and they give you half of the guidelines/.

Hi,

I had my application through NCS.
I can confirm that you do not need to fill in absences from the country. What the lady said is just to fill in date of birth in top box.
I had in fact already filled all sections and she said that's OK but in theory not needed.

So no need to fill whole section.
