Naturalization and Passport

HI, I applied for Naturalisation in 1 June 2015. I have given all biometric data and currently waiting for the approval. I have a personal situation that I have to travel to Australia soon and be there for couple of months. We went on holiday to Australia and my wife had an accident. She is pregnant and with her condition she is living with my in laws as she is in safe hands during her pregnancy. But it is closer to the due dates and I want to travel to Australia. My plan is that I travel to Australia and will return to UK in six months’ time.

• Appreciate if you could advise whether I can request the ceremony to be conducted in UK high commission in Australia if I travel now.
• If I get the Naturalisation certificate from UK high commission in Australia, can I apply for my UK passport from there.

Scenario two.
• If I get my Naturalisation certificate before my travel , can I travel using my original non UK passport to Australia and can I apply for the UK passport from Australia when I land there.


Both me and my wife is currently on ILR. Appreciate if you could clarify ,When my little boy come to the world (in Australia) what will be his immigration status on the following two scenarios.

• If I do not get UK naturalisation by the time he is out
• If I have the Naturalisation but still not have the UK passport with me yet by the time he is out

Please advice.

#1 I don't know.

#2 Yes, travel on Australian passport to Australia is probably expected anyway.
If it's another foreign passport & you have the appropriate visa that should obviously work too.

Check on VFS website for applying for a British passport in Australia.

Note: A UK naturalisation certificate will, in any case, grant you entry into UK as it confirms the holder's 'right of abode'.
(It's not a travel document so foreign passport also necessary, as you mention).

Your BRP ID will not guarantee you entry into UK anymore after naturalisation as ILR terminates & BRP will be cancelled;(although some people find they 'work' for a short time after naturalisation it's not guaranteed).

If entering UK with just a naturalisation certificate, (for example, if passport from abroad doesn't work out in time), you may face delays for a few extra questions on entry.

#3 In general, for a child born abroad to non-UK parents, the child will be able to be 'registered' as a UK citizen once one parent is naturalised and the other is also naturalised or settled in UK.
Note: This registration of a minor as a UK citizen is not an entitlement, it is at the Home Secretary's discretion.

If born in UK to British, or naturalised citizens, or settled parents the child will be British automatically (other than by descent);
in this case there is no need to register the child as British, simply apply for passport.

This option is only available to spouse of British Citizens who is/are/will be abroad. You will need to attend your ceremony in the UK and if you don''t book and attend it within the timeframes given (90 days), you might have problems and your certificate could get sent back to HO and you might have to apply again. Is there someone in the UK who will be checking your mail while you are away?

If you have your certificate, you can apply for a passport from abroad, however, bear in mind that it is processed in the UK and take a considerable length of time.
When my little boy come to the world (in Australia) what will be his immigration status on the following two scenarios.
If child is born AFTER you attend your ceremony and receive your certificate, the child will be British by Descent automatically.

If the child is born BEFORE you are British (attend ceremony etc.), the child is not British and will require a visa/ILE to enter the UK on form VAF4A - settlement visa.

In terms of citizenship, if your future is in UK it's much better & morer straightforward if your child can be born in UK.

I appreciate it's a difficult & sensitive situation but is there any way your wife can travel back to UK?
(medical evacuation under travel insurance perhaps).
